According to the mainstream position in the bioethical definition of death debate, death is to be equated with the cessation of an organism. Given such a perspective, some bioethicists uphold the position that brain-dead patients are dead, while others claim that they are alive. Regardless of the specific opinion on the status of brain-dead patients, the mere bioethical concept of death, according to many bioethicists, has the merit of being unanimous and univocal, as well as grounded in biology. In the (...) present article, we challenge such a thesis. We provide evidence that theoretical biology operates with a plurality of equally valid organismic concepts, which imply different conclusions regarding the organismal status of a brain-dead patient. Moreover, the theoretical biology concepts of an organism are very distant from the view on an organism that appears by way of bioethicists theorizing on death. We conclude that if death is to be understood as the cessation of an organism, there is no single correct answer to the question of whether a brain-dead patient is alive or dead. (shrink)

The paper presents an overview of research on working memory as a predictor of early school achievements. We contrast two main areas of research on the role of working memory in school achievements: the first concerns the structural model of working memory and the second focuses on executive functions. Then, we discuss the facet model of working memory as a promising approach merging the two research branches on working memory tasks as predictors of early school achievements. At the end we (...) present exemplary results of the research conducted on a national sample of six- and seven-year-olds in Poland, which indicates strong relation of working memory functions with the measures of competences in mathematics, reading, and writing. Additionally, the mediation analyses, with parents’ education as a covariate, indicate that the influence of age on achievements in math, reading, and writing in six- and seven-year olds is mediated by working memory functions. The mainstream concept of death—the biological one—identifies death with the cessation of an organism. In this article, I challenge the mainstream position, showing that there is no single well-established concept of an organism and no universal concept of death in biological terms. Moreover, some of the biological views on death, if applied in the context of bedside decisions, might imply unacceptable consequences. I argue the moral concept of death—one similar to that of Robert Veatch—overcomes such difficulties. The moral view identifies (...) death with the irreversible cessation of a patient’s moral status, that is, a state when she can no longer be harmed or wronged. The death of a patient takes place when she is no longer capable of regaining her consciousness. In this regard, the proposal elaborated herein resembles that of Veatch yet differs from Veatch’s original project since it is universal. In essence, it is applicable in the case of other living beings such as animals and plants, provided that they have some moral status. (shrink)

Singer claims that there are two ways of challenging the fact that brain-dead patients, from whom organs are usually retrieved, are in fact biologically alive. By means of the first, the so called dead donor rule may be abandoned, opening the way to lethal organ donation. In the second, it might be posited that terms such as “life” and “death” do not have any primary biological meaning and are applicable to persons instead of organisms. This second possibility permits one to (...) acknowledge that brain-dead patients are deceased because they are irreversibly unconscious. In the commentary which follows, I will argue that Singer’s second option is preferable since it provides a higher amount of organs available for transplant, and is better suited to the meaning of “death” which occurs in ordinary language. I will also defend such a concept of death against the objections raised by Michael Nair-Collins in the article Can the brain-dead be harmed or wronged? In their insightful article, Brent Kious and Margaret Battin (2019) correctly identify an inconsistency between an involuntary psychiatric commitment for suicide prevention and physician aid in dying (PAD). They declare that it may be possible to resolve the problem by articulating “objective standards for evaluating the severity of others’ suffering,” but ultimately they admit that this task is beyond the scope of their article since the solution depends on “a deep and difficult” question about comparing the worseness of two possible (...) scenarios: letting someone die (who could have been helped) with not letting someone die (whose suffering could only be alleviated by death). In our commentary, we argue that creating such standards is more difficult than the authors assume because of the many types of deep uncertainties we have to deal with: (1) diagnostic, (2) motivational, and (3) existential. While agreeing with the main conclusion of Dominic Wilkinson and colleagues (Wilkinson, Butcherine, and Savulescu 2019), namely, that there is no moral difference between treatment withholding and withdrawal as such, we wish to criticize their approach on the basis that it treats the widespread acceptance of withdrawal aversion (WA) as a cognitive bias. Wilkinson and colleagues understand WA as “a nonrational preference for withholding (WH) treatment over withdrawal (WD) of treatment” (22). They treat WA as a manifestation of loss aversion (...) and refer to Kahneman and colleagues (1991), which defined this effect as follows: “the disutility of giving up an object is greater that the utility associated with acquiring it” (194). In a previous work, Wilkinson and Savulescu understood nonequivalence between treatment withholding and withdrawal as a reflection of slightly different, although related, phenomena: status quo bias or omission bias (Wilkinson and Savulescu 2012, 130–131). In neither of these two papers do they describe precisely the relation between these well-known psychological effects and WA, nor do they explain why they treat these effects as examples of nonrational preferences, despite the fact that these issues have been the subject of wide-ranging discussions on the intersection of psychology, economy, and philosophy. The article provides a critical overview of the Polish bioethics literature concerning the shortage of organs for transplantation. Problems related to this issue bear, to a considerable degree, on the attempt to answer the question how to increase the number of organs available in ethically acceptable ways. Polish authors have focused, in this respect, on the analysis and assessment of two solutions: an opt out system of acquiring organs and a system that allows the aquisition of organs on a “free (...) market”. Both solutions have been almost unanimously negatively assessed. Apart from the presentation and critique of the positions of Polish bioethicists on this matter, an important part of the text is constituted by a report from a debate, held at the national level, on the criteria and definition of death: for it is only from the deceased donors that unpaired bodily organs, such as heart, can be taken. ABSTRACT:According to the mainstream bioethical stance, death constitutes the termination of an organism. This essay argues that such an understanding of death is inappropriate in the usual context of determining death, since it also has a social bearing. There are two reasons to justify this argument. First, the mainstream bioethical definition generates an organismal superposition challenge, according to which a given patient in a single physiological state might be both alive and dead, like Schrödinger's cat. Therefore, there is no clear (...) answer as to whether organ retrieval from a brain-dead patient is an act of killing or not. Second, when combined with the dead donor rule, the mainstream position in the definition of death might lead to ethically unacceptable verdicts, since there is a discrepancy between terminating an organism and depriving someone of moral status. In 2017, Michael Nair-Collins formulated his Transitivity Argument which claimed that brain-dead patients are alive according to a concept that defines death in terms of the loss of moral status. This article challenges Nair-Collins’ view in three steps. First, I elaborate on the concept of moral status, claiming that to understand this notion appropriately, one must grasp the distinction between direct and indirect duties. Second, I argue that his understanding of moral status implicit in the Transitivity Argument is faulty since (...) it is not based on a distinction between direct and indirect duties. Third, I show how this flaw in Nair-Collins’ argument is grounded in the more general problems between preference utilitarianism and desire fulfillment theory. Finally, I present the constructivist theory of moral status and the associated moral concept of death and explain how this concept challenges the Transitivity Argument. According to my view, brain death constitutes a valid criterion of death since brain death is incompatible with the preserved capacity to have affective attitudes and to value anything. (shrink)

Biomedical sciences cannot answer the question who should be saved from death if not everyone can be. This is an ethical issue. However, we face exactly this question when deliberating on the criteria for organ allocation. The main aim of this article is to formulate a pluralistic theory of just distribution of organs, which incorporates the tenets of utilitarianism, egalitarianism and sufficientarianism. Each constituent theory adopts a different value as a criterion for organ allocation. For utilitarianism it is a health (...) benefit for the patient, for egalitarianism it is the ratio of deserts and health-related well being, for sufficientarianism what is important is that the candidate for a transplant be situated below the sufficientarian threshold. The following text is a voice in the discussion around normative problems of innovative therapies. It particularly refers to the meaning of the concept of innovation, also discussed in this issue in the article by Tomasz Rzepiński "Advanced therapy medicinal products (ATMP) as products of innovative biotechnologies.".

In the article I justify the acceptability of ex vivo transplantation and I provide the ethical evaluation of trafficking in human organs from the Kantian perspective. Firstly, I refer to passages of Kant's works, where he explicitly states that depriving oneself of one’s body parts for other purposes than self-preservation is not permitted. I explain that the negative ethical evaluation of the disposal of the body parts was given various justifications by Kant. Subsequently, I provide partial criticism of this justification, (...) resulting in the recognition of the admissibility of ex vivo transplantation. Secondly, I analyse the Kantian slippery-slope argument which, as some philosophers believe, supports banning trade in human organs. It turns out, however, that this argument has wider application, namely it applies to all forms of the instrumental treatment of the human body. Using a previously introduced distinction between organs of the first and the second order, I show that the slippery-slope argument is inconclusive. However, I propose a reinterpretation of this reasoning, which results in using this argument as an additional reason to support prohibiting trade in human organs. (shrink)

In the article I argue for replacing the opt-out system of organ donation, currently applied in Poland, with the Active Donor Registration system. The basic idea of the ADR system is to send a special form to all adult citizens, which would give them an opportunity to consent or dissent to the removal of organs, or to delegate their decision to their next of kin. Granting priority to declared donors – an additional assumption of ADR – would make it possible (...) for them to acquire better access to transplantation if they ever contract a disease whose effective treatment will require transplantation. I highlight the basic assumptions of both systems and describe the functioning of the Polish opt-out regulations. I also analyze the statistical data illustrating the scale of organ shortage in Poland, and I present and criticize the basic ethical principles of evaluating organ procurement systems and compare the Polish system with the ADR system from the perspective of those principles. The present paper constitutes an introduction to a special issue of Diametros devoted to Setting Health-Care Priorities. What Ethical Theories Tell Us by Torbjörn Tännsjö. The book in question states that there are three moral theories which have valid implications in the field of the distribution of medical resources in a healthcare system: utilitarianism, the maximin/leximin view, and egalitarianism. A number of authors have contributed to this special issue with papers which challenge this thesis. Robert E. Goodin argues that, besides (...) general moral theories, some local principles of justice might be valid. Quinn Hiroshi Gibson states that Tännsjö should have considered the Rawlsian view on justice in its contractualist reading. Jay A. Zameska argues that his “revised lexical sufficientarianism” constitutes a more reliable moral view than prioritarianism. Finally, Lasse Nielsen points out that there is more to say about distributive justice than consequentialist theories can grasp. Moreover, he puts forward an argument in defense of prioritarianism. The final article in this issue constitutes Tännsjö’s replies to his critics. (shrink)

We investigate ideals of the form {A⊆ω: Σn∈Axnis unconditionally convergent} where n∈ωis a sequence in a Polish group or in a Banach space. If an ideal onωcan be seen in this form for some sequence inX, then we say that it is representable inX.After numerous examples we show the following theorems: An ideal is representable in a Polish Abelian group iff it is an analytic P-ideal. An ideal is representable in a Banach space iff it is a nonpathological analytic P-ideal.We (...) focus on the family of ideals representable inc0. We characterize this property via the defining sequence of measures. We prove that the trace of the null ideal, Farah’s ideal, and Tsirelson ideals are not representable inc0, and that a tallFσP-ideal is representable inc0iff it is a summable ideal. Also, we provide an example of a peculiar ideal which is representable inℓ1but not in ℝ.Finally, we summarize some open problems of this topic. (shrink)

The scientific papers published in a special edition of the journal “Scientia et Fides” are the result of an international scientific project titled “The Dynamic Theodicy Model: Understanding God, Evil, and Evolution.” The project leaders are Prof. Piotr Roszak (Nicolaus Copernicus University) and Prof. Saša Horvat (University of Rijeka), under the auspices of the University of Oxford and the John Templeton Foundation. Other members of the project team include Grzegorz Karwasz, Michał Oleksowicz, Tomasz Huzarek, and Jan Wółkowski.

Grzegorz Musiał’s late work is exemplary of the Modernist coupling of desire and death, which German Ritz linked to the way that homosexual sensibility has been encoded in Polish literary Modernism. This reading of Musiał is paradoxical at heart, as the writer’s literary output must also be ridden with tensions, because his clinging to a bygone aesthetic in order to render homosexual desire seems quaint in an era in which the idea of gay emancipation is widespread. Musiał’s literary alter (...) ego, who is realized as a fictional character and as the speaker in his poems, is a hybrid of an erudite homosexual male equipped with the classical sensibility and a devout Catholic, whose appreciation and outright enjoyment of church ritual is almost camp. Musiał attempts to pit this literary dummy against the usually younger homosexual men who, like a mob of the living dead, populate the underground world of night clubs and anonymous sex. (shrink)

The speech act of inquiry is generally treated as a default kind of asking questions. The widespread norm states that one inquires whether p only if one does not know that p. However, the fact that inquiring is just one kind of asking questions has received little to no attention. Just as in the declarative mood we can perform not only assertions, but various other speech acts, like guesses or predictions, so in the interrogative mood we can also make various (...) speech act types. I propose a speech-act-theoretic account of a distinct kind of question that I label exam questions. According to the proposed account, one performs an exam question p only if (i) one has access to the answer to p, and (ii) one does not officially know whether the hearer knows the answer to p. Exam questions satisfy all the necessary requirements of being a distinct kind of speech act. Additionally, my proposal contributes to the recent expansion of the normative approach to a variety of speech acts. (shrink)

According to the normative approach, speech acts are governed by certain norms. Interestingly, the same is true for classes of speech acts. This paper considers the normative treatment of constatives, consisting of such classes as assertives, predictives, suggestives, and more. The classical approach is to treat these classes of illocutions as species of constatives. Recently, however, Simion (Shifty Speech and Independent Thought: Epistemic Normativity in Context, Oxford University Press, 2021) has proposed that all constatives (i) are species of assertion, and (...) (ii) are governed by the knowledge norm. I defend the classical treatment of constatives and show that Simion’s conclusion is untenable. No taxonomy of speech acts can accommodate such a view. More importantly, we can test whether a particular speech act is an assertion or not. I propose five tests of assertion, the passing of which is a necessary condition for being an assertion. Some constative speech acts fail these tests. Thus, contrary to Simion, not all constatives can be regarded as species of assertion. (shrink)

I propose an analysis of lying with uninformative speech acts. The orthodox view states that lying is restricted to assertions. However, the growing case for non-assertoric lies made by presuppositions or conventional implicatures challenges this orthodoxy. So far, the only presuppositions to have been considered as lies were informative presuppositions. In fact, uninformative lies were not discussed in the philosophical literature. However, limiting the possibility of lying to informative speech acts is too restrictive. Firstly, I show that standard, uninformative presuppositions (...) can also be lies. Secondly, I extend this picture into uninformative lies made by declarative statements. To implement my proposal, I do not need a new definition of lying. Recently popular commitment-based definitions of lying are able to properly handle uninformative lies. (shrink)

This paper offers a systematic classification and characterization of speech acts and their norms. Recently, the normative approach has been applied to various speech acts, most notably to constatives. I start by showing how the work on the norms of assertion has influenced various approaches to the norms of other speech acts. I focus on the fact that various norms of assertion have different extensions, i.e., they denote different clusters of illocutions as belonging to an assertion. I argue that this (...) has consequences for theorising about norms of other speech acts and generates certain arbitrary divisions. In the central part, I analyse two groups of speech acts. Firstly, ordinary speech acts, like predictions or retractions. Secondly, I indicate how the normative view can be extended to so-called ancillary speech acts, like presuppositions or implicatures. I end with a discussion of possible extensions of the normative approach, focusing on the debate on lying. (shrink)

Due to the development of global economy and increased geographical and occupational mobility, communication with people from multicultural backgrounds has become commonplace in many healthcare institutions. As the demographic profiles of both patients and medical personnel are increasingly varied, intercultural competence has become an integral component of English for Medical Purposes training. However, are medical students generally familiar with the notion of intercultural competence? What intercultural aspects should they be aware of in order to practise effectively when they graduate? The (...) aim of this article is to present medical students′ understanding of IC based on a survey conducted among undergraduate learners at the Medical University of Bialystok, Poland. The article begins with a discussion on intercultural competence in the context of health care. In Dystopia: A Natural History, Gregory Claeys observes that the collectivist ethos is one of the common features of both utopia and dystopia. The crucial difference is that in utopia cooperation is free and voluntary, whereas in dystopia it takes the form of what Leszek Kołakowski has called compulsory solidarity, that is, solidarity imposed by means of coercion and thus deprived of its actual value.1 And yet, just as dystopia and utopia may well be two sides of the same coin, (...) dystopian compulsory fraternity is often counterbalanced by voluntary cooperation within an actual social system or a textual representation thereof. We show that that every countable model of PA has a conservative extension M with a subset Y such that a certain Σ1(Y)-formula defines in M a subset which is not r. e. relative to Y.

The paper is concerned with the problem of characterization of strengthenings of the so-called Łukasiewicz-like sentential calculi. The calculi under consideration are determined by n-valued Łukasiewicz matrices with superdesignated logical values. In general, Łukasiewicz-like sentential calculi are not implicative in the sense of [7]. Despite of this fact, in our considerations we use matrices analogous to S-algebras of Rasiowa. The main result of the paper says that the degree of maximality of any n-valued Łukasiewicz-like sentential calculus is finite and equal (...) to the degree of maximality of the corresponding n-valued Łukasiewicz calculus. Questions about the intrinsic value of nature are not only an abstract philosophical speculation, they have a practical meaning, can inspire and motivate people to act. Environmental ethics attempts to overcome the anthropocentric and personalistic attitude of traditional ethics. It emphasizes the intrinsic value of nature, value, which is independent from humans. Within non-anthropocentric environmental ethics there are individualistic and holistic trends. Biocentric individualism raises problems with resolving conflicts of interests of different organisms, with the hierarchy of beings, while holistic (...) ethics does not count with the well-being of individuals. Ethical holism should be contrasted with practical holism as a methodological postulate. The pragmatic current of ecological ethics acknowledges that the good of people and the intrinsic good of nature coincide. In a pluralistic, liberal society there should be a convergence of radical, biocentric and moderate, anthropocentric concepts of ecological ethics. (shrink)

Topic modeling—a text‐mining technique often used to uncover thematic structures in large collections of texts—has been increasingly frequently used in the context of the analysis of scholarly output. In this study, we construct a corpus of 19,488 texts published since 1971 in seven leading journals in the field of bioethics and philosophy of medicine, and we use a machine learning algorithm to identify almost 100 topics representing distinct themes of interest in the field. On the basis of intertopic correlations, we (...) group the content‐based topics into eight clusters, thus providing a novel, fine‐grained intellectual map of bioethics and philosophy of medicine. Moreover, we conduct a number of diachronic analyses, examining how the “prominence” of different topics has changed across time. In this way, we are able to observe the distinct patterns in which bioethics and philosophy of medicine have evolved and changed their focus over the past half a century. (shrink)

The widely accepted view states that an intention to deceive is not necessary for lying. Proponents of this view, the so-called non-deceptionists, argue that lies are simply insincere assertions. We conducted three experimental studies with false explanations, the results of which put some pressure on non-deceptionist analyses. We present cases of explanations that one knows are false and compare them with analogical explanations that differ only in having a deceptive intention. The results show that lay people distinguish between such false (...) explanations and to a higher degree classify as lies those explanations that are made with the intention to deceive. Non-deceptionists fail to distinguish between such cases and wrongly classify both as lies. This novel empirical finding indicates the need for supplementing non-deceptionist definitions of lying, at least in some cases, with an additional condition, such as an intention to deceive. The following article begins with my recollection of the only academic conference on Zdziechowski that was organised still under the communist regime in the autumn of 1984 at the Jagiellonian University and ends with a description of the discussion on the genesis and power of evil, with the participation of Czesław Miłosz and Leszek Kołakowski, which was triggered in Poland immediately after the publication of the last edition of On Cruelty in 1993. On Cruelty was first published in 1928 in (...) the journal Przegla̧d Współczesny [Contemporary Review] in Krakow, a second time in 1938 in the volume of articles In the Face of the End, Krakow 1938, and a third – and so far last – time also in Krakow in 1993. On Cruelty, published three times but so far only in Polish, has never been thoroughly analysed or even discussed, which is why this article focuses on discussing it and related questions about the origins and nature of evil, mainly in Europe and Asia, from the earliest times to the present. Zdziechowski was particularly outraged when the cruelty he condemned was justified by religion, especially Christianity (Catholic and Protestant). From these condemnations, he described the activities of the Inquisition, the witch trials, cruelty to animals, and – in the introduction – the “psychology of cruelty.” At the same time, however, he meticulously listed the names of those political and spiritual leaders in Europe and Asia, theologians and thinkers, who, over many centuries, up to the present day, have resolutely spoken out against evil, including cruelty, within and outside the Church. A separate and important issue is Zdziechowski’s attitude to Tsarist Russia and Bolshevism, as outlined in his work On Cruelty. On the one hand, he pointed out that at least two rulers of Russia before 1917 – Ivan the Terrible and Peter the Great – had made major contributions to the history of cruelty in Europe and Asia. But Bolshevism, which Zdziechowski condemned in the strongest terms, was in his eyes not a continuation of pre-1917 Russian despotism, but emanated from the depths of Asia. (shrink)

Celem artykułu jest poszukiwanie takiej interpretacji obecności i działania Boga w świecie, jaka pozwoliłaby zharmonizować istotne prawdy wiary z naukowym obrazem świata, którego ewolucja jest rządzona przypadkiem i pozbawiona kierunku. Poszukiwanie to jest realizowane w kilku krokach. Odwołując się do różnych koncepcji celowości wskazuje się najpierw, że jeśli można mówić o tym, że świat ma taką cechę, to nie w sensie zmierzania w określonym kierunku, lecz w sensie celowości wewnętrznej: świat ze swej natury jest skierowany na Boga. Współcześnie o Bożej (...) celowości w świecie mówi się często w kategoriach ogólnego lub szczególnego działania Boga. Artykuł, podejmując tę kwestię zmierza do wniosku, że odróżnienie aspektu naturalnego od nadnaturalnego w danym zdarzeniu jest przypuszczalnie niemożliwe. Na jeden z powodów tej niemożliwości wskazuje tzw. zasada domknięcia przyczynowego, dlatego jest ona analizowana w kolejnym punkcie artykułu. Wskazuje się tutaj między innymi na konieczność zrewidowania niektórych klasycznych koncepcji cudu. W odniesieniu zaś do takich przełomowych zdarzeń z dziejów świata, jak powstanie życia czy pojawienie się człowieka, proponuje się hipotezę niedookreśloności celu stworzenia: Bóg może realizować swoje cele w świecie rządzonym przez autentyczny przypadek, jeśli cele te są rozumiane odpowiednio subtelnie. Na przykład, jeśli celem Boga jest pojawienie się w świecie istoty zdolnej do nawiązania z nim świadomego kontaktu, to istota taka niekoniecznie musiała przyjąć postać przedstawiciela gatunku Homo sapiens. Na koniec wskazuje się na panenteizm jako na właściwą, prawdziwie chrześcijańską wizję świata, który jest „losem i przeznaczeniem” samego Boga. W tej perspektywie, detale ewolucyjnego rozwoju świata przestają być religijnie istotne, a sama religia uwalnia się ostatecznie—po części pod wpływem współczesnej nauki—„od błędu i przesądu”. Predictive processing (PP) has been repeatedly presented as a unificatory account of perception, action, and cognition. In this paper, we argue that this is premature: As a unifying theory, PP fails to deliver general, simple, homogeneous, and systematic explanations. By examining its current trajectory of development, we conclude that PP remains only loosely connected both to its computational framework and to its hypothetical biological underpinnings, which makes its fundamentals unclear. Instead of offering explanations that refer to the same set of (...) principles, we observe systematic equivocations in PP‐based models, or outright contradictions with its avowed principles. To make matters worse, PP‐based models are seldom empirically validated, and they are frequently offered as mere just‐so stories. The large number of PP‐based models is thus not evidence of theoretical progress in unifying perception, action, and cognition. On the contrary, we maintain that the gap between theory and its biological and computational bases contributes to the arrested development of PP as a unificatory theory. Thus, we urge the defenders of PP to focus on its critical problems instead of offering mere re‐descriptions of known phenomena, and to validate their models against possible alternative explanations that stem from different theoretical assumptions. Otherwise, PP will ultimately fail as a unified theory of cognition. (shrink)
